Smiley emoticon registrered as trademark

Russian businessman Oleg Teterin has registered the smiley emoticon as a trademark for his Superphone mobile company. He is going to ask the companies using the sign for compensation. These could be the popular social network, Corbina Telacom, Nestle, and McDonalds.
      Kommersant reported Teterin is going to send emails to companies warning them against using the emoticon. It would be possible for the companies to purchase one-year contracts for the use of the smiley sign. He claimed such services as ICQ or which use the smiley sign in their charts will also have to pay for it. Market players say Teterin will hardly find fools who'd be prepared to pay for using the sign.
